By accessing and using FirstQA ("Service"), including the Ovi AI-powered QA analysis tool and related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Service Description

FirstQA provides AI-powered QA testing and analysis services for software development workflows, including but not limited to:

• Automated PR analysis and test coverage assessment
• AI-generated test recipes and risk analysis
• Integration with GitHub and other development platforms
• Access to human QA experts when needed

While we strive to provide accurate and helpful analysis, we cannot guarantee that our AI will identify every potential issue or bug in your code.

3. User Accounts and Registration

To use certain features of the Service, you must:

• Be at least 18 years old or have parental consent
• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

You grant us a limited license to process your code for the purpose of providing QA analysis services.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We disclaim all warranties, express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be error-free or uninterrupted
• Warranties regarding the accuracy of AI analysis results

10. Limitation of Liability

IN NO EVENT SHALL FIRSTQA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, EVEN IF THE OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claims arising from the use of the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless FirstQA and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

12. Termination

You may terminate your account at any time by contacting us. We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will cease immediately, and we may delete your account and data.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration.
